A2, 3, 4: If a non-Muhram person hunts a pigeon, a gazelle, or anything else from outside the land of the Haram, from Jeddah or Abha or similar, and then enters with it into Makkah al-Mukarramah, or if the one who bought it enters with it into Makkah or elsewhere in the land of the Haram, it is permissible for him to sell it, slaughter it, and eat it, and it is permissible for others to eat from it according to the correct opinion, as stated by Malik and al-Shafi'i and Dawud. This is based on what is established from Anas (may Allah be pleased with him), that he had a young brother called Abu 'Amir , and he had a small bird (naghir) that he played with. The bird died, and the Prophet (peace and blessings be upon him) used to say:Sunan Abi Dawud 4969Sahih (Al-Albani) Narrated by al-Bukhari and Muslim . The point of indication in this is that the naghri is part of the category of game, and it was with Abu 'Amir in the Haram of Madinah , and the Prophet (peace and blessings be upon him) did not disapprove of it. Also, what is prohibited is the hunting of a person in the state of Ihram, and the hunting of what is in the Haram. This is not hunting in the Haram, nor hunting by a person in the state of Ihram. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
