The questioner : What is the ruling, O honorable Shaykh, on the fact that some people, when a person dies, take all of his wealth, and give the sons from this wealth, and do not give the daughters on the pretext that the daughters do not claim this wealth? I ask for guidance in this matter?

The Shaykh : This is forbidden, indeed it is among the major sins, and may Allah protect us from it, because when Allah the Exalted mentioned inheritance, the inheritance of spouses and maternal siblings, who are more distant than descendants and ancestors, He said:
(13) These are the limits [set by] Allah, and whoever obeys Allah and His Messenger will be admitted by Him to gardens [in Paradise] under which rivers flow, abiding eternally therein; and that is the great attainment. (14) And whoever disobeys Allah and His Messenger and transgresses His limits - He will put him into the Fire to abide eternally therein, and he will have a humiliating punishment. تلك حدود الله ومن يطع الله ورسوله يدخله جنات تجري من تحتها الأنهار خالدين فيها وذلك الفوز العظيم ، ومن يعص الله ورسوله ويتعد حدوده يدخله نارا خالدا فيها وله عذاب مهين
[An-Nisa 4:13-14]
, thereby making clear that these are the limits of Allah, and that whoever transgresses the limits of Allah and disobeys Allah and His Messenger will be entered into a Fire in which he will abide forever. So the believer must give every one who has a right his right from the inheritance, whether they are men or women.
So if a person dies leaving two sons and a daughter, it is obligatory that the daughter be given one-fifth of the wealth, and four-fifths to the two sons, each one receiving two-fifths, by the saying of Allah the Exalted:
Allah instructs you concerning your children: for the male, what is equal to the share of two females يوصيكم الله في أولادكم للذكر مثل حظ الأنثيين
[An-Nisa 4:11]

And these customs and traditions are invalid, pre-Islamic age of ignorance (jahiliyyah) customs that it is not permissible for anyone to prioritize over the Shari'ah of Allah ever, and it is obligatory that every one who has a right be given his right, and that the case be brought to the judge, so that he rules in it by the Shari'ah of Allah, so that this unjust, invalid, pre-Islamic age of ignorance (jahiliyyah) custom is removed.
