The first and third questions of Fatwa No. ( 6496 )
Q1: I have a transaction related to the Shari'ah court, so I gave someone an amount of money to produce it for me as a Shari'ah check, for example, and the land is mine with no one contesting it. So, does this fall under bribery , and is
there a sin on me if I did something like this?
A1: If what he did to issue a check for you regarding the land is not part of the work he is obligated to do by virtue of his job, then the money you paid him is not a bribe. And if it is something he is obligated to do by virtue of his job, then it is not permissible.
Q3: There is a headman who does not sign for anyone except for an amount of fifty or one hundred riyals, and he receives a salary from the state . What is the ruling on giving him money? And is there a sin on us if we give it to him because we are forced to rely on him for things like birth certificates and other needs?
A3: The ruling on that is the ruling on bribery. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
