The third question of Fatwa No. ( 2231 )
Q 3: A person vowed to slaughter a sheep at one of the shrines. Is it obligatory for him to fulfill the vow, or may he slaughter the sheep in any place?
A 3: Slaughter at graves is a religious innovation (bid'ah) and a means to major shirk (associating partners with Allah). Therefore, it is not permissible for one who vowed to slaughter at a grave to fulfill his vow; because his vow is a vow of disobedience, and it is not permissible to fulfill a vow of disobedience. This is based on what is established in (Sahih al-Bukhari ) from A'ishah (may Allah be pleased with her), that the Messenger of Allah (peace and blessings be upon him) said:
Whoever vows to obey Allah, let him obey Him, and whoever vows to disobey Allah, let him not disobey Him.من نذر أن يطيع الله فليطعه، ومن نذر أن يعصي الله فلا يعصه

It was narrated by al-Bukhari, and what was narrated by Abu Dawud (may Allah have mercy on him) with a sound chain from Thabit ibn al-Dahhak (may Allah be pleased with him), who said:
A man vowed to slaughter camels at Bawānah, so he asked the Messenger of Allah (peace and blessings be upon him), and he said: "Was there an idol among the idols of the pre-Islamic age of ignorance (jahiliyyah) that was worshipped there?" They said: "No." He said: "Was there a festival among their festivals there?" They said: "No." The Messenger of Allah (peace and blessings be upon him) said: "Fulfill your vow, for there is no fulfillment of a vow in disobedience to Allah, nor in what the son of Adam does not possess."نذر رجل أن ينحر إبلاً ببوانة، فسأل رسول الله صلى الله عليه وسلم، فقال: هل كان فيها وثن من أوثان الجاهلية يعبد؟ قالوا: لا، قال: فهل كان فيها عيد من أعيادهم؟ قالوا: لا، فقال رسول الله صلى الله عليه وسلم: أوف بنذرك فإنه لا وفاء لنذر في معصية الله، ولا فيما لا يملك ابن آدم
Sunan al-Bayhaqi 17:1048
. As for if the slaughtered animal is for the owner of the grave, then that is major shirk; due to the saying of Allah, the Exalted:
(162) Say, "Indeed, my prayer, my rites of sacrifice, my living and my dying are for Allah, Lord of the worlds. (163) No partner has He. And this I have been commanded, and I am the first [among you] of the Muslims."قُلْ إِنَّ صَلاَتِي وَنُسُكِي وَمَحْيَايَ وَمَمَاتِي لِلَّهِ رَبِّ الْعَالَمِينَ (162) لاَ شَرِيكَ لَهُ وَبِذَلِكَ أُمِرْتُ وَأَنَا أَوَّلُ الْمُسْلِمِينَ
[Al-An'am 6:162-163]
, and it is authentic from the Messenger of Allah (peace and blessings be upon him) that he cursed the one who slaughters for other than Allah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
