Fatwa number ( 19916 )
Q: My father was suffering from epilepsy, and he went to hospitals and doctors, as well as to shaykhs and fortune-tellers, and they said: You are under a spell. The point is
this illness caused some minor car accidents, and we would tell him: Do not drive the car, and he would say: Leave me alone. He had a car accident and passed away, may Allah have mercy on him and reward him, and the cause of the accident was that he had a seizure while driving the car and hit one of the sidewalks. Do we bear a sin because we did not drive the car in his place? I was not present with him on the days of the accident because I was working in the north, and my brothers had told him: We will go with you, but he refused and said to them: I have been driving the car since ancient times. When I learned that he had passed away, I did not believe it and I wept for him intensely, and I am still affected by his passing to this day. Do I bear a sin? In some nights I dream of him, and I say to him: Where did you go? And I weep at his presence, and when I wake up from sleep, I wake up weeping for him. When he was alive, I wanted to take a leave and take him to one of the shaykhs of Riyadh city. There is a sponsorship for orphans in the Relief Authority, where 100 riyals are paid each month for an orphan. Is it permissible for me to sponsor an orphan in the name of my father, may Allah have mercy on him? And what are the charities that are recommended to be paid to the deceased? I have not performed Hajj, and I want to perform Hajj on behalf of my father, may Allah have mercy on him. Is that permissible?
A: Your father’s death in the accident was by divine decree and destiny, and you owe nothing in that matter. You should be patient, seek reward from Allah, and be kind to your mother and your brothers.
And part of being dutiful to him is to increase in supplication for him, asking for forgiveness, mercy, and success in Paradise, and to give charity on his behalf, and to perform Hajj and 'Umrah on his behalf, after you have performed Hajj and 'Umrah for yourself. As for your father going to the fortune-tellers, that is a forbidden matter, and we ask Allah to forgive him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
