Fatwa number ( 15470 )
Q: I am a married man with five children, praise be to Allah, but I wish to marry my maternal aunt's daughter—my mother's sister. However, I am confused and I ask your eminence to guide me in this matter. It is summarized as follows: A - I was breastfed by my maternal grandmother, my mother's mother , and her older sister was also breastfed by my maternal grandmother. B - I was breastfed by my second maternal aunt—my mother's second sister—and my mother breastfed her, and my second maternal aunt breastfed the children of the maternal aunt from whom I wish to marry . C - I was breastfed by my maternal uncle's wife, who breastfed the children of the maternal aunt from whom I wish to marry, and my mother also breastfed my maternal uncle's children. I have a strong desire to marry my maternal aunt's daughter. I ask your eminence to guide me to the right path, may Allah make you a treasure for Islam. Note that I was not breastfed by the maternal aunt whose daughter I wish to marry, and she was not breastfed by my mother.
A: For breastfeeding to establish a prohibition, it must occur within the first two years of the child's life, and it must consist of five breastfeedings or more. The definition of a breastfeeding is that the child holds the breast and sucks milk; when he releases it, either to rest or to move to another breast, it is counted as one breastfeeding, and so on until five breastfeedings are completed. If
it falls short, even by one breastfeeding, it does not establish a prohibition. This is based on the saying of the Exalted in His mention of those who are prohibited:
your [milk] mothers who nursed you, your sisters through nursingوَأُمَّهَاتُكُمُ اللاتِي أَرْضَعْنَكُمْ وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ
[An-Nisa 4:23]
, and the saying of the Messenger of Allah (peace and blessings be upon him) in the hadith agreed upon by al-Bukhari and Muslim:
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful.يحرم مـن الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
. Muslim narrated from 'A'ishah (may Allah be pleased with her) that she said:
Ten known breastfeedings were revealed in the Qur'an as establishing a prohibition, then five were abrogated from that, and it became: (Five known breastfeedings establish a prohibition). The Messenger of Allah (peace and blessings be upon him) passed away while the matter remained as suchأنزل في القرآن عشر رضعـات معلومـات يحرمـن، فنسـخ مـن ذلك خمـس وصـار إلى: (خمـس رضعـات معلومـات يحرمن) فتوفي رسول الله صلى الله عليه وسلم والأمر على ذلك
. And from 'A'ishah (may Allah be pleased with her) she said: The Messenger of Allah (peace and blessings be upon him) said:
One or two sucks does not make marriage unlawfulلا تحرم المصة ولا المصتان
Sunan Abi Dawud 2063Sahih (Al-Albani)
, narrated by Muslim . If your breastfeeding from your maternal grandmother, your mother's mother, was five breastfeedings or more within the first two years, then it is not permissible for you to marry your maternal aunt's daughter, because you would be her maternal uncle through breastfeeding. And if your maternal aunt's daughter was breastfed by the maternal aunt from whom you were breastfed, and the breastfeeding of each of you was five breastfeedings or more within the first two years, then she becomes your sister through breastfeeding, making you her brother on one side and her maternal uncle on the other.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
