Q: I am a man who has been married to my maternal aunt’s daughter for nine years, and Allah has blessed us with children. It is known that my maternal uncle (my mother’s brother) nursed from my mother many times. The question: Do I (the husband of my maternal aunt’s daughter) become a maternal uncle to my wife through nursing? And if so, what is required of me after that?
A: The conditions for breastfeeding that establishes prohibition are that it must occur within the first two years of the child's life, and that it must be five breastfeedings or more. The definition of a breastfeeding is that the child holds the breast and sucks milk; when he releases it, either to rest or to move to another breast, it is counted as one breastfeeding, and so on until five breastfeedings are completed. If it is less, even by a single breastfeeding, it does not establish prohibition. This is based on His saying, the Exalted, regarding those who are prohibited:[An-Nisa 4:23], and His saying (peace and blessings be upon him) in the hadith agreed upon by al-Bukhari and Muslim: Sunan Ibn Majah 1937Sahih (Darussalam). Muslim narrated from A'ishah (may Allah be pleased with her) that she said: "It was among what was revealed in the Qur'an that ten known breastfeedings establish prohibition, then they were abrogated by: 'five known breastfeedings.' The Messenger of Allah (peace and blessings be upon him) passed away while they were still among what was recited from the Qur'an." And from A'ishah (may Allah be pleased with her) she said: The Messenger of Allah (peace and blessings be upon him) said: Sunan Abi Dawud 2063Sahih (Al-Albani). Muslim narrated it. The breastfeeding that establishes prohibition is what has been described above.
