Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the President General from the questioner, the head of the Sharjah Court of Fujairah and its dependencies, registered with the Research Department under number (856) and dated 23 \ 3 \ 1405 AH. The questioner asked the following: We seek your Eminence’s assistance with the request submitted by one of the brothers in the state of the United Arab Emirates dated 15 \ 11 \ 1984 CE, registered with us under number (196) on 24 \ 2 \ 1405 AH, containing his question about a man who married a woman who was breastfed by his ex-wife, who is the mother of some of his children. She breastfed her for a month from the milk of another. The woman who was breastfed by his ex-wife is still in his marriage bond, and he has seven children from her. We hope that your Eminence, after reviewing the matter, will issue the Islamic ruling for the aforementioned question and guide the questioner with what you deem appropriate and achieving
the public benefit. May Allah reward you with good and bless you, and peace be upon you and the mercy of Allah and His blessings.

A: If the matter is as stated, and if the woman was breastfed by his ex-wife five times or more within the two-year period, then she is not permissible for him; because she is his foster daughter. Allah the Exalted said:
Prohibited to you [for marriage] are your mothers, your daughtersحُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ
[An-Nisa 4:23]
, up to His saying:
your step-daughters under your guardianship [born] of your wives unto whom you have gone inوَرَبَائِبُكُمُ اللاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللاتِي دَخَلْتُمْ بِهِنَّ
[An-Nisa 4:23]
, and He said:
Mothers may breastfeed their children two complete yearsوَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ
[Al-Baqarah 2:233]
. It is established from the Prophet (peace and blessings be upon him) that he said:
What is unlawful by reason of consanguinity is unlawful by reason of fosterage.يحـرم من الرضاعة ما يحرم من الولادة
Sunan Abi Dawud 2055Sahih (Al-Albani)
. It is established from the hadith of Aisha (may Allah be pleased with her) that she said: It was among what was revealed in the Qur'an: "Ten known breastfeedings prohibit [marriage]," then it was abrogated by: "Five known [breastfeedings]." The Messenger of Allah (peace and blessings be upon him) passed away while the matter remained as such. Know that a breastfeed is: when the child holds the breast and then sucks milk from it. If he leaves it and then returns and sucks milk, it is a second breastfeed, and so on. If the breastfeeding is less than five times, or after the two-year period, it has no effect on the marriage.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
