The first question of fatwa number ( 13121 )
Q1: If the wife of the deceased was pregnant and then gave birth, and he had another wife, do they all exit the mourning period?
A1: The waiting period of a pregnant woman whose husband has died ends with the complete delivery of the fetus, and so does the mourning period. The waiting period and mourning period of a woman who is not pregnant are four months and ten days. Allah the Exalted said:
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days]وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
[Al-Baqarah 2:234]

And He said:
And for those who are pregnant, their term is until they give birthوَأُولاتُ الأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[At-Talaq 65:4]
The Prophet (peace and blessings be upon him) ruled in favor of Saba' al-Aslamiyyah that she exited the waiting period of widowhood upon the delivery of her pregnancyوقد حكم النبي -صلى الله عليه وسلم- لسبيعة الأسلمية بخروجها من عدة الوفاة بوضع الحمل
As for the woman who is not pregnant, she does not exit the mourning period due to the delivery of her co-wife’s pregnancy. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
