The first question of Fatwa No. ( 3784 )
Q1: What is your opinion, Your Eminence, regarding a man who had two wives, the first being a virgin and in his debt, and the second being pregnant and in his debt? He passed away, and they observed the mourning period for one month. After this month, the pregnant woman gave birth to a boy, and they asked some people, who said: The man the newborn boy ends the mourning period for his mother and for his aunt, the wife of his deceased father. Is this correct or not?
A1: It is only the waiting period of the woman who gave birth and her mourning period for her deceased husband that end with her delivery. As for the one who was not pregnant at the time of her husband's death, her waiting period and mourning period do not end except by the passage of four months and ten days from the date of her husband's death. And there is no basis in the Shari'ah for what some people claimed, namely that the second wife's waiting period ends by giving birth to a male child; rather, it is
one of the superstitions of the common people. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
