Q1: We have brothers in Kuwait during the invasion, and this group left, except that the head of the family refused to leave, and the remaining family left for Saudi Arabia . After a period of five months, one of the brothers called us and said: Your father is missing. After the liberation period, we went to Kuwait to search for this man. Someone told us that he was in the hospital, unconscious. We went to the hospital and found him deceased. We asked when he died, and they said four and a half months ago. We took the man, prayed over him, and buried him. This is the man's story, and the question is: Does the wife of this man observe the mourning period, or what does she do, given that the mourning period is four months and ten days, and a long time has passed since his death? May Allah guide us to what He loves and is pleased with.
A1: If the wife does not learn of her husband's death until after the waiting period and mourning period have passed, then she is not required to observe a waiting period or a mourning period. After the passage of four months
and ten days from the husband's death, she owes nothing, due to her lack of knowledge of the death, provided she is not pregnant. If she is pregnant, then it is upon the delivery of the child. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
