The third question of Fatwa No. ( 14506 )
Q3: A man was taken prisoner by the enemy, and his wife fled to another country. The man remained a prisoner with them until they killed him. The wife did not learn of her husband's death until two months and a few days later. How is her waiting period in the case of death calculated? Is it two months and a few days, given that more than two months have passed since her husband's death, or is she required to complete the full four months and ten days?
Volume 3: The waiting period for a woman whose husband was killed and she was unaware of it is calculated from the time of his death. She observes a waiting period of four months and ten days, provided she is not pregnant from the time of his death, even if news of his death did not reach her until some of the period had already passed.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
