The questioner : The second question is from a sister who says: A man is married to a woman and has three children from her, and he married another woman, who is her sister's daughter, and he lived with her until she bore him three sons and one daughter. But we heard on this program that it is not permissible to marry a woman and her sister's daughter together. What is the ruling on this marriage of theirs, and what must they do?
The Shaykh : This marriage of theirs is not valid; rather, it is invalid. It is obligatory to separate him from this last wife, because it is established from the Prophet (peace and blessings be upon him) that he said:Sahih Muslim 1408a And Allah the Exalted mentioned the marriage of two sisters together among the prohibited matters, saying: [An-Nisa 4:23] And the Sunnah also clarified that marrying a woman and her aunt or her sister's daughter is forbidden. Therefore, it is obligatory to separate this man from the woman with whom he contracted this forbidden marriage. Nothing of the rulings of marriage is established by this contract, except if she bore children from him while in a state of ignorance. In that case, these children are attributed to their father, and they become the children of their father and their mother.
