Q2: Some doctors sell the drug samples that companies distribute to doctors for their use in their work, knowing that these samples are prohibited from being sold in the markets, and they are labeled “free samples, sale prohibited,” and they circumvent this by erasing this phrase. Is this permissible? And if the company representative knows that the doctor is selling the samples, and asks for more in order to continue prescribing the drug, does the company representative sin if he provides more to the doctor, knowing how he is disposing of them? And what is the ruling on the pharmacist’s dealing in these samples, whether selling or buying, knowing their nature?
A2: It is not permissible for the doctor to accept these samples in the first place, and a fortiori, it is not permissible for him to sell them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
