Fatwa number ( 10796 )
Q: I asked some relatives to marry me their daughter, but some minor problems arose, so I declared all the daughters of the thigh forbidden by saying that the daughters of the (..)
They are forbidden to me, and they are to me like my mother, then Allah willed that I marry one of them,
and I now have two children from one of them. Then some people told me: You owe an expiation for zihar. I asked some scholars, and they advised me to send this to your eminence. I have read in the book (al-Mughni), volume 7, page 354, in the section of Imam Ahmad,Imam Ahmadthat there is an expiation for someone like what I have described. I hope from Allah, and then from you, that you would be kind enough to issue a ruling on this matter, and on the ruling regarding the children I have, and whether I must abstain from my family until I perform the expiation? Knowing that this matter occurred due to ignorance of this issue. Please rule for us, may you be rewarded.

A: You must pay the expiation for an oath, along with repentance to Allah the Exalted for that; because it is not permissible for a Muslim to declare forbidden what Allah has made lawful for him, and because the expiation for zihar is only obligatory in the case of declaring one’s wife forbidden, and these are not wives. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
