The Ruling on a Woman Making Herself Forbidden to Her Husband

At the beginning of this episode, we return to a letter from one of our female listeners from Iraq, (K. M. S). Our sister, we presented a question from her letter in a previous episode.
In this episode, she asks and says: If a woman makes herself forbidden to her husband, what is the ruling?
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and the outcome is for the righteous. And may prayers and peace be upon His servant and messenger, His intimate friend and His trustee over His revelation, our Prophet, our Imam, and our master Muhammad ibn Abdullah, and upon his family and his Companions, and whoever follows his path and is guided by his guidance until the Day of Judgment.
As for what follows: Prohibiting what Allah has made lawful is not permissible. Therefore, a woman must not make her husband forbidden to her, and a man must not make his wife forbidden to him, and no one among people may prohibit what Allah has made lawful. So one should not say: "Meat is forbidden to me," or "Milk is forbidden to me," or "Fruit is forbidden to me," or "Grains are forbidden to me," or anything else of what Allah has made lawful. Allah (Glorified and Exalted is He) said: :
O Prophet, why do you prohibit [yourself from] what Allah has made lawful for you, seeking the approval of your wives? And Allah is Forgiving and Merciful.يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ تَبْتَغِي مَرْضَاةَ أَزْوَاجِكَ وَاللَّهُ غَفُورٌ رَحِيمٌ
[Surat al-Tahrim: 1]. And He said, Exalted is He, regarding those who practice zihar with their wives, meaning: they make their wives forbidden to them:
And indeed, they are saying an objectionable statement and a falsehood.وَإِنَّهُمْ لَيَقُولُونَ مُنْكَرًا مِنَ الْقَوْلِ وَزُورًا
[Surat al-Mujadilah: 2].
Therefore, neither a believer man nor a believing woman may prohibit what Allah has made lawful. If a man makes his wife forbidden to him and practices zihar with her, he must pay the expiation, which is freeing a believing slave. If he does not find one, he must fast for two consecutive months. If he is unable to do so, he must feed sixty poor people, thirty sa' (a dry measure of about 3 kg) for each poor person, half a sa' of the local staple food, such as dates or otherwise. He must not approach her until he has fulfilled the expiation, as explicitly stated in the Book of Allah in Surat al-Mujadilah.
As for the woman, she does not have the ruling of zihar; rather, it is specific to the man; because Allah said:
And those who pronounce thihar from their wivesوَالَّذِينَ يُظَاهِرُونَ مِنْ نِسَائِهِمْ
[Surat al-Mujadilah: 3].
As for the woman, if she makes her husband forbidden to her by saying: "You are to me like the back of my father," or "You are forbidden to me," or "I am forbidden to you," or something similar, then by doing so she has erred and made a mistake, and she must repent and seek forgiveness; because she has prohibited what Allah has made lawful for her. She must only pay the expiation for an oath; because of the saying of Allah, Glorious and Exalted:
(1) O Prophet, why do you prohibit [yourself from] what Allah has made lawful for you, seeking the approval of your wives? And Allah is Forgiving and Merciful. (2) Allah has already ordained for you [Muslims] the dissolution of your oathsيَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ تَبْتَغِي مَرْضَاةَ أَزْوَاجِكَ وَاللَّهُ غَفُورٌ رَحِيمٌ ۝ قَدْ فَرَضَ اللَّهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ
[Surat al-Tahrim: 1-2]. He named his (peace and blessings be upon him) prohibition of honey, as in the well-known narration, or of Mary the slave girl, an oath.
Likewise, if a man prohibits food, drink, fruit, or a woman who is not his wife, he must pay the expiation for an oath. Likewise, if a woman prohibits her husband, or prohibits fruit, or the speech of so-and-so, or visiting so-and-so, she must pay the expiation for an oath. She does not have zihar; zihar is specific to the husband. As for her, she must pay the expiation for an oath, which is feeding ten poor people, or clothing them, or freeing a slave. If she is unable, meaning: she becomes poor, then she must fast for three days. Thus, Allah, Exalted is He, explained in His saying, Glorious and Exalted:
Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave. But whoever cannot find [or afford it] - then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oathsلا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ
[Surat al-Ma'idah: 89], the verse.
So He (peace and blessings be upon him) made it obligatory to keep the oath, and that whoever makes an oath and then breaks it must pay the expiation. And Allah said, Exalted is He, in the story of His Prophet (peace and blessings be upon him) when he prohibited honey:
Allah has already ordained for you [Muslims] the dissolution of your oathsقَدْ فَرَضَ اللَّهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ
[Surat al-Tahrim: 2]. So the ruling on prohibiting what Allah has made lawful is the ruling of an oath.
Ibn Abbas said regarding this: "It is an oath that is expiated." Yes.
