Q4: What is the ruling on accepting gifts from my parents and relatives who work in the tobacco company and in banks ? Should I accept them from them and then return their value to them in another way, in order to preserve affection and maintain family ties? Q5: And when I visit my relatives and they offer me something, should I eat and drink from it, given that their source of income is working in banks and tobacco companies?
A4, 5: If you know that what is given to you as a gift, or the food offered to you to eat, is specifically forbidden, then do not eat from it and do not accept it as a gift. The ruling is the same if all of their earnings are forbidden. However, if what they have earned from lawful sources is not distinguished from what they have earned from forbidden sources, there is a difference of opinion among scholars regarding accepting a gift from them or eating food in their hospitality or the like. It was said: It is absolutely forbidden. It was said: If the forbidden portion exceeds one-third, then eating from it and accepting their gift is forbidden. It was said: If the forbidden is more than the lawful, then consuming it by eating and accepting it as a gift is forbidden. It was said: It is not absolutely forbidden; one accepts the gift from one whose earnings are mixed and eats from it if he offers it to him as food. This is the apparent view, because the Prophet (peace and blessings be upon him) accepted a roasted sheep from a Jewish woman and ate from it. And due to the generality of the statement of Allah the Exalted:
and the food of those who were given the Scripture is lawful for youوَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ
[Al-Ma'idah 5:5]
It is well known that the Jews and the Christians eat usury and do not seek lawful earnings; rather, they earn both forbidden and lawful. Allah has permitted eating their food, and the Prophet (peace and blessings be upon him) ate from it. A group of scholars narrated from the hadith of Sufyan al-Thawri from Salama ibn Kahil from Zirr ibn 'Abd Allah from Ibn Mas'ud , that a man asked him, saying: "I have a neighbor who eats usury and keeps inviting me." He said:
His invitation is a blessing for you, and his sin is upon him. If the Muslim were to purify himself from mixing with them and from excessive gift-giving and visiting between them, and limit it to what is called for by public benefit or pressing need, that would be better for him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
