Q: I am a young Muslim who graduated from a hospitality school in Morocco , and I am currently working as an employee in a restaurant in Germany . In this restaurant, I serve intoxicants to the restaurant's guests, and I dislike this work. Please issue a ruling on the matter: 1 - Am I permitted to continue my work to earn a livelihood for my children as an employee in a restaurant in a non-Muslim country? 2 - I would like to perform Hajj to the House of Allah this year, if Allah wills. Does the Shari'ah permit me to perform this obligation with money from this profession?
A: What the texts of the Shari'ah indicate is that the Muslim is commanded to seek out food, drink, clothing, housing, and expenses for Hajj, jihad, and other matters from good, lawful wealth. Muslim narrated in his book (Sahih) from Abu Hurayrah (may Allah be pleased with him) who said: The Messenger of Allah (peace and blessings be upon him) said:Sahih Muslim 1015 Therefore, the Muslim who is sincere to himself must seek work that brings him good earnings, from which he spends on himself and his children. There are many jobs, and whoever fears Allah, He will make a way out for him and provide for him from where he does not expect. By this, it is known that the work mentioned in the restaurant is not permissible; because it involves assisting in sin and transgression. And Allah (Glorified and Exalted is He) says: [Al-Ma'idah 5:2] And he must repent to Allah (Glorified and Exalted is He) and leave this work which involves assisting in what Allah has forbidden, such as drinking intoxicants. As for his Hajj from the money he has collected, there is no blame on him in that, if Allah wills, after repenting from his work, because he was ignorant of the legal ruling. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

Allah is Good and He therefore, accepts only that which is good. And Allah commanded the believers as He commanded the Messengers by saying: "O Messengers, eat of the good things, and do good deeds; verily I am aware of what you do" (xxiii. 51). And He said: "O those who believe, eat of the good things that We gave you" (ii. 172). He then made a mention of a person who travels widely, his hair disheveled and covered with dust. He lifts his hand towards the sky (and thus makes the supplication): "O Lord, O Lord," whereas his diet is unlawful, his drink is unlawful, and his clothes are unlawful and his nourishment is unlawful. How can then his supplication be accepted?
إن الله تعالى طيب لا يقبل إلا طيبًا، وإن الله تعالى أمر المؤمنين بما أمر به المرسلين فقال تعالى: يَا أَيُّهَا الرُّسُلُ كُلُوا مِنَ الطَّيِّبَاتِ وَاعْمَلُوا صَالِحًا الآية وقال تعالى: يَا أَيُّهَا الَّذِينَ آمَنُوا كُلُوا مِنْ طَيِّبَاتِ مَا رَزَقْنَاكُمْ وَاشْكُرُوا لِلَّهِ إِنْ كُنْتُمْ إِيَّاهُ تَعْبُدُونَ - ثم ذكر الرجل يطيل السفر - أشعث أغبر يمد يديه إلى السماء: يا رب يا رب، ومطعمه حرام، ومشربه حرام، وملبسه حرام، وغذي بالحرام، فأنى يستجاب لذلكbut do not cooperate in sin and aggression
وَلاَ تَعَاوَنُوا عَلَى الإِثْمِ وَالْعُدْوَانِ
