Q: I built a water tank for use inside the house, for myself and for others who benefit from it. This was a long time ago—eight years or more. The people of the house and others drew water from it throughout this entire period. And by the decree and destiny of Allah, we had a daughter who was five years old who used to draw water from it as her habit, because she was always taking water from it for her family at all times, and she was accustomed to it and continued taking water from it without any unusualness in that. And by the decree and destiny of Allah, on the day of 17/12/1401 AH, she went to take water from it as usual and she fell into this tank and died to the mercy of Allah, Mighty and Majestic. Therefore, I seek your ruling in my matter: is there anything upon me regarding her? Because I am the one who caused the digging and construction of the tank. And what is incumbent upon me, out of my fear of Allah, the High and Mighty? Rule for me in my matter, may Allah reward you.
A: If the reality of your situation and the girl's situation is as you described, then there is no blood money or expiation upon you. Merely building the tank is not considered a cause for sin or your being held liable for any of that.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
