Q: During a sermon in the al-Harjah market, a man raised a question: his wife had given birth to a child who was two months old, and she placed him near a fire . She left her son and went to another house, and sparks from the fire flew onto her child and caught fire. He passed away in this incident. It is mentioned that this case occurred four years ago. Therefore, there is an expiation for the mother of the child, and she has offered herself to prepare for what has been issued by your Eminence.
A: If the situation is as described, where she placed her two-month-old son near the fire, left the house, and her son was burned by the sparks of fire that flew onto him, then she owes the expiation for accidental killing due to her negligence in guarding her child,
Allah the Exalted said:
And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charityوَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ إِلا أَنْ يَصَّدَّقُوا
[An-Nisa 4:92]
, up to His saying:
And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ تَوْبَةً مِنَ اللَّهِ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا
[An-Nisa 4:92]
, and feeding is not sufficient for this; because Allah the Exalted did not mention it in the expiation for accidental killing, and your Lord is not forgetful. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
