Q:She had a small infant daughter and placed her in the *mizab* (a wooden trough or cradle), while she was with her in the bed under the blanket, and in the morning she found that the girl had died.This is the first question. The second question: On another occasion, she had a son who was about one year old, and she placed him in the back of the house, and in the front of the house was his brother, and she placed his brother, who was four years old, with the child, and said: “Guard your brother from the fire so he doesn’t go to it.” Eventually,the boy neglected his younger brother, and he fell into the fire and died. Does the mother owe an expiationfor this? We ask for your guidance.
A: According to what was mentioned in the first case, your mother owes nothing regarding the death of the girl, because she did not cause her death, and the original state is that the conscience is clear. As for the second case: if the situation is as described, then your mother was negligent in leaving the child near the fire, and there was no one there to prevent him from it except a small child who does not have discernment. Therefore, an expiation is obligatory upon her, which is: freeing a believing slave. If she cannot find one, then she must fast for two consecutive months (sixty days).
