Q: Your Eminence, one day my father was ill, so I took him to the hospital in my car. On the way, we were involved in a traffic accident, and both my father and I were taken to the hospital. My father passed away as a result of that accident. The fault was assessed at 25% for me and 75% for the person who caused the accident, who is of Egyptian nationality. We, the heirs of the deceased, have legally waived our personal right against that Egyptian. My question here is: 1 - I was informed that I must fast two consecutive months as expiation. I have fasted the months of Rajab and Sha'ban. If Sha'ban is completed and Ramadan begins, what should I do? May Allah reward you with good. 2 - I was informed by some shaykhs, may Allah reward them with good, that I do not inherit from my deceased father. Please issue a ruling for us. May Allah reward you with good.
A: You must fast the second day of Shawwal to complete the sixty days; because you have only fasted fifty-nine days, since the month of Rajab this year, 1417 AH, was twenty-nine days, and the month of Sha'ban was thirty days. Fasting Ramadan does not break the consecutiveness of the obligatory expiation fast required of you. As for the matter of
inheritance, looking into it is the exclusive jurisdiction of the courts. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
