Fatwa No. ( 7479 )
Q: I am a First Sergeant (L.H.A.) in the Border Forces. I was previously assigned a mission by my superiors. After returning from the mission, before reaching my workplace, I saw a small car refueling at a gas station. I suspected it, so I monitored it until it passed through the town, crossing the main paved road. I and all the personnel with me pursued it in official vehicles. We continued the pursuit until it overturned on a curve in the paved road. We stopped at the scene and found that it was loaded with intoxicants, and one of its passengers died as a result of the overturning , while one was alive. The competent authority did not hold the patrol responsible for any liability. Please inform us, may Allah reward you with good, whether we are required to fast on account of the deceased?
A: If the situation is as described, there is no expiation required of you or of the personnel with you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
