The ruling on one who died in a car overturn while being pursued by the security authorities
Machine translationRead the Arabic original
Question: Your Eminence, the Shaykh Abdul Aziz ibn Abdullah ibn Baz, may Allah preserve him.
Peace be upon you and the mercy of Allah and His blessings:
We are three individuals from the Narcotics Control Administration, and we were performing our duty at an inspection center on the southern route, in coordination with a group of our colleagues from the police and traffic departments. A car carrying two people came to us, and we requested them to stop, but the driver continued driving and did not stop. We three pursued this car, by order of our direct supervisor, and the pursuit extended for approximately fifty-five kilometers, with us driving behind this car, which was in our sight. We notified the security authorities on the road to stop this car, but the driver veered toward another area called (Turba) -also on a paved road- and we continued pursuing him. An accident occurred to him during our pursuit of him, as the car overturned after going off the paved road and returning to it again. The driver died immediately, and the passenger died after an attempt to provide first aid upon his arrival at the hospital. Please note that we did not make contact with the aforementioned individuals with our car, and the traffic report stated that the overturn was due to the car veering off the asphalt and returning to the asphalt again. A report was issued regarding the driver stating that alcohol was found in his blood.
The investigation in the case has concluded, and the documents have been archived for a period, and nothing has been issued against us from the authority.
We hope you will graciously provide us, the three of us, with a fatwa: whether we have an expiation? And is it an expiation on us individually for each of us, or one expiation? And peace be upon you and Allah's mercy and blessings, and may Allah preserve you.
Answer: Peace be upon you and Allah's mercy and blessings, after which:
If the situation is as you described, then there is no expiation on you; because you only did what is obligatory for you to do for the benefit of the Muslims and the preservation of security. May Allah guide them all.
And peace be upon you and the mercy of Allah and His blessings.
