Q: I was pregnant, and in the seventh month I chopped wood with an axe, then the piece of wood I had cut came back and struck me in the belly ,
and since the fetus made a strong movement and a week later the fetus was delivered dead, and it was a female, what is obligatory for me to do regarding this? Knowing that I did not do it intentionally, and that this fetus was my last pregnancy; from others, nine who did not survive, and I am now between 70 and 80 years old. Give me a ruling, may Allah reward you with good for me.

A: If the situation is as you described, you owe the blood money (diyah) for this fetus, which is one-tenth of the blood money of its mother, and its amount in Saudi paper currency is two thousand, unless its heirs waive it, and you have no inheritance from it. You also owe the expiation (kaffarah) for accidental killing, which is: freeing a believing slave. If you cannot find one, you must fast two consecutive months; for Allah the Exalted said:
And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charityوَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ إِلا أَنْ يَصَّدَّقُوا
[An-Nisa 4:92]
, until He said:
And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ تَوْبَةً مِنَ اللَّهِ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا
[An-Nisa 4:92]
. And we ask Allah to magnify your reward and to help you in fulfilling the obligation.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
