Q: I present to your Eminence that I was obligated to fast two consecutive months because I hit a person with my vehicle and he died. I had started fasting, and after
ten days—and I was a taxi driver—I became exhausted; so I decided to break the fast
, and my intention was to postpone the fasting to another time. When I broke the fast and returned home, I felt better; so I fasted the rest of the period. The question is: Does my fasting of sixty days, with one day of breaking the fast after ten days from the beginning, count as consecutiveness or not, and is it sufficient for the obligation?

A: It is a condition in the fasting of the two months—the expiation for accidental killing—that they be consecutive, except for a legitimate excuse such as illness, or a permissible journey, or the day of Eid, and so on. Accordingly, if your breaking the fast on that day you mentioned was because you were unable to continue fasting it due to the exhaustion that overtook you, which prevented you from completing the fast—then your action is not considered a break in the consecutiveness. Otherwise, you must consider the beginning of the fasting for the two months to be from after that day on which you broke the fast. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
