The second question of Fatwa No. ( 12373 )
Q2: A man threw a cow's dung, which contained a small stone, at his wife, and it hit her stomach while she was pregnant, causing her to miscarry a boy and a girl who were both over six months old. The man has passed away and he has two daughters. If an expiation of fasting is required, can it be distributed among his two daughters?
and is blood money required of him, and is there an expiation for each one or a single expiation?
A2: It is obligatory upon the man who threw at his wife and she miscarried: blood money and expiation. The blood money is a slave (ghurrah), which is taken from the estate before division to the heirs, and the ghurrah is one-tenth of the mother’s blood money, to be distributed to the heirs. The expiation is fasting for two months for each of them. It is prescribed for his two daughters to perform this, with each one fasting for two months, so that each one is independent in the expiation; due to the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 1147 It is agreed upon as authentic. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
