Fatwa number ( 14576 )
Q: A valid marriage took place, and this wife gave birth to a child. The husband's mother took him to a side of the house and placed him in a safe location without covering his face or doing anything to him. In this situation, she became afraid and distressed by this bad situation. After a period of time, that is, after three to four hours, she was surprised to find that the newborn had died. The question is: What is incumbent upon me, the husband's mother, regarding this newborn's death? I was ignorant of what happened, and my health condition is not stable; I suffer from asthma in my chest, and I am approximately seventy to eighty years old. Also, this incident happened twenty years ago. May Allah send prayers and blessings upon our master Muhammad, his family, and his companions, and may peace and the mercy and blessings of Allah be upon you.
A: It is obligatory for the husband's mother to pay the blood money (diyah) and the expiation (kaffarah), and to repent to Allah (Mighty and Majestic); because she placed him in a location and neglected him until he died. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
