Q: My family and I traveled to Makkah al-Mukarramah to perform the 'Umrah. It was Thursday, 7/8/1411 AH, and praise be to Allah, we stayed for several days near the House of Allah . After that, we traveled from Makkah al-Mukarramah to the city of Abha . We continued the journey, but while driving, I suddenly fell asleep, which caused a change in the car's direction. I tried to prevent the accident, but Allah decreed it, and the car fell from a high place, carrying us all down into the valley. As a result, my wife and two daughters passed away, making a total of three women deceased. We ask Allah, the Most High, the All-Powerful, to shower them with His vast mercy and settle them in the spacious Paradise. He is the All-Hearing, the Responsive. I hope that after reviewing this, you will refer this case to His Eminence Shaykh 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to issue a fatwa on what he sees fit, knowing that my financial situation cannot afford freeing a slave or consecutive fasting. Indeed, to Allah we belong and to Him we return
and to Him we return, and may Allah send prayers and peace upon our master and trustworthy Prophet Muhammad, and upon his family and all his Companions.
A: It is obligatory for you to pay the expiation for accidental killing for every soul that died with you in the aforementioned accident. The expiation is: freeing a believing slave. If you do not find one, then you must fast two consecutive months whenever you are able. There is no harm in separating each two-month period with a duration in which you rest. And success is from Allah, and may Allah send prayers and peace upon our Prophet Muhammad, his family, and his Companions.
