Q: A traffic accident occurred with my car, resulting in the death of my passenger. The summary court in Buraydah issued a ruling—according to what is attached to your Eminence—ordering me to pay twenty-five percent of the blood money (diyah) for the deceased, and seventy-five percent of the accident liability to my tribe. I paid fifty thousand riyals to the heirs of the deceased, and they have released me from the claim. I seek a fatwa from your Eminence: What is obligatory for me in the Shari'ah in place of fasting? Fasting is difficult for me because of the need to earn a living. If I am required to fast for two months, I am prepared to purchase a slave and free him. We ask Allah, the Exalted and Almighty, to grant you success and to bestow upon you abundant reward and recompense.
A: It is obligatory for you to pay the expiation for accidental killing, because you participated in causing the death of the person accompanying you. The expiation is: freeing a believing slave. If you cannot find one, then fast for two consecutive months.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
