Q: I am the one addressed as (S. M. M). I was on a trip from the city of
Khamis Mushayt to my village in al-Far'iyyin. In the middle of the road, there was an open traffic light ahead of me, and there was a car in front of me which I assumed was moving because the light was open for us. Suddenly, my car collided with that car. After the accident, my family, who were with me in the car, were taken to the house, and I completed my procedures with the traffic department. Then I returned to the house and found my little daughter unwell, so I took her to the hospital that night and stayed at the hospital that night until the next day. Then she passed away, may Allah have mercy on her, and she was four months old. I inform you, O Noble Shaykh, that she was unwell before the accident; she was suffering from a deficiency in the bones of her head and body, and her bones were thin, so they would break from any movement. And O Noble Shaykh, I inform you that I suffer from a mental illness, which is depression and anxiety, and I have been and still am to this day using sedative pills, which I take from the Mental Health Hospital in Abha for a period of ten years. Do you find an exit for me, O Noble Shaykh, from this dilemma? It is: fasting two consecutive months or freeing a slave. May Allah guide you, O Noble Shaykh, to serve Islam and the Muslims, and accept my sincere greetings.
A: If it is established that your daughter passed away as a result of that accident, or that it increased the pain she was suffering from until she passed away as a result of it, then it is obligatory upon you to pay the expiation for accidental killing, which is freeing a believing slave. If you do not
find one or are unable to do so, then you must fast two consecutive months, that is, sixty days. If you are unable to do that, then it remains a debt upon you until you are able to free a slave or fast, as mentioned previously. This is because you caused the death of your daughter, as you did not take care to ensure whether the car in front of you was stopped or moving, and your lack of attention to this led to your collision with the car stopped in front of you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
