Fatwa number ( 6484 )
Q: My father died in a car accident along with his mother and his sister. The accident report stated that they died at the same hour, and Allah knows best about that. I want to distribute my father’s estate. Please note that he has no children other than me. My maternal grandmother, who died with him, has no children other than the daughter who died with them in the same accident. His sister, who died with them, has four sons and a daughter. Do they inherit from one another in this case or not? I mean my father, his mother, and his sister.
A: If the matter is as you described, and your father, his mother, and his sister all died in the accident, and it is not known who among them died first, then they do not inherit from one another. Each deceased person is inherited by his or her heirs other than those who died with him or her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
