Fatwa number ( 19633 )
Q: I gave birth to a child naturally, and on the third day after his birth, I sprinkled him with water and cleaned him as is customary, just as I did with all my previous children. After that, I began to feel that he was not normal, as his color changed and he became unable to move. We immediately took him to the hospital, where they performed a blood transfusion, and he stayed in the hospital for two months. However, his condition did not improve; rather, it worsened. Then he was discharged from the hospital, and we took him home. After that, we took him to several reciters to have him treated with ruqyah, hoping that Allah would cure him. Some said that he was afflicted with a curse, and some said that he had a companion (jinn) and needed cauterization. But I was afraid of cauterization and did not do it. As for the hospitals, they say that he is disabled, and he has grown very slowly. We spent a lot of money on him, hoping for his cure from Allah, but to no avail. After he reached the age of five, it was mentioned to us that there was someone like him whom Allah cured through one of the reciters. We actually took him to that man, who asked for a sum of money as an advance, and the rest of the amount after he was cured, by the permission of Allah, and that he should climb stairs and so on.
This man was confident in himself, and out of our joy at that news, we gave him the amount he asked for. But unfortunately, after his treatment by this man, his condition worsened, and he stopped eating and drinking. Then we took him to the hospital, where he stayed for several days, and his condition continued to deteriorate. One day after his discharge from the hospital, my child passed away; may Allah make him a store of good and an intercessor for me and his father. The question: Due to the circumstances of his illness, we did not circumcise him, nor did we perform the 'aqiqah sacrifice for him. Do we have any sin, expiation, or anything else to answer for? Because I have heard that one who is not circumcised and for whom the 'aqiqah is not performed does not intercede for his parents. I see him in my dreams frequently these days, and so do his brothers, as if he is alive or as if he has been cured of his illness. Therefore, I wanted to ask so that my conscience may be at ease, and I hope for your fatwa in light of my problem and these questions. May Allah place that in the scale of your good deeds.
A : If the matter is as you described, then you have no expiation for the death of the aforementioned child, because you did not neglect your duty. There is nothing required of you regarding the leaving of his circumcision, and it is recommended for you to slaughter the 'aqiqah sacrifice for him in accordance with the Sunnah, hoping to obtain its reward. May Allah guide everyone to what is good. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
