Q: Ifmy mother caused the death of her young daughter, who was still of nursing age, by covering her with a heavy blanket, and my mother passed away three months after the girl’s death, does she owe an expiation, and how can I make it up for her now that she has died?
A: If the death of the aforementioned child occurred because she suffocated under the heavy blanket that your mother placed on her, then it is obligatory for
your mother to pay the expiation, which is: freeing a believing slave. If she cannot find one, then fasting two consecutive months. Since she has passed away, if she left an estate, the expiation is paid from her estate by purchasing a slave and freeing it, if possible. If obtaining a slave is not possible, it is recommended for you or one of her relatives to fast two consecutive months on her behalf; based on the saying of the Prophet (peace and blessings be upon him):
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: If anyone dies in a state (that he had to complete) some fasts, his heir must fast on his behalf.من مات وعليه صيام صام عنه وليه
