Q: I have an elderly woman, approximately 85 years old, who has a heart condition. The doctors have forbidden her from fasting the month of Ramadan, and her heart is functioning on a device. She wishes to make expiation for the expiation of accidental killing , as she previously slept with her daughter, who was in her first year of life, and caused her immediate death. I ask you to kindly inform me of the ruling of the Shari'ah in this matter: is it charity or freeing a slave? Please note that she is unable to fast or free a slave.
A: If this woman caused the death of the aforementioned child,
then she must make expiation, which is: freeing a slave. If she cannot find one, then she must fast two consecutive months. Fasting becomes obligatory only when one is unable to free a slave. Therefore, if she is unable to free a slave, she must fast the two months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
