Question: The questioner says about herself: She gave birth to her child within forty days, and she placed him in her bed and covered him from the cold. When she came to him, she found him dead. She fasted for fifteen days, and her husband asked the shaykh, who said: She owes nothing. So she broke the fast. What do you think—may Allah reward you—about that?
Answer: If the one you asked is from among the people of knowledge, such as the judges who have knowledge—may Allah will it—then what he saw is sufficient. If she asked those who are not known for their knowledge, then she should be asked: If she covered him with something heavy without a barrier to lift it off him—like a chair or something else, as people do when they place things to lift the blanket off a small child—if she placed a heavy shawl or blanket on him that pressed against his face, then she is a killer, and it is obligatory for her to free a believing slave. If she cannot do that, she must fast for two consecutive months, sixty days.
The fifteen days she fasted are void for her; they do not benefit her because they were interrupted. However, if she only placed something on him to warm him, but it was raised on sticks or on a chair or on a raised saddle, then she owes nothing.
