Q: I have a daughter who is one year old. One day, one of my sisters drove a car on the order of my older brother, who is forty years old. The sister who drove the car was nine years old, and she was driving to fill it with gasoline. My daughter was among a group of children who were around the car, and her mother did not know anything about her, as she was busy inside the house. When the girl tried to drive the car, the children climbed onto the car, except for the aforementioned girl, who was in front of the car on the right side without the knowledge of the girl who was driving the car. Allah willed that the car run over her, and she died instantly. Therefore, I ask Allah, then you, to inform us with a sufficient explanation of what
is required of us by way of expiation or otherwise. It is known that the girl who was driving the car is now sixteen years old. Does fasting or expiation become obligatory upon her, or upon the older brother who ordered her to drive the car while she was young, or upon the mother who was inside the house, or upon whom is it obligatory?

A: The matter of the blood money is for the court to consider. As for the expiation, it is upon the one who gave the order, who is your older brother. The expiation is freeing a believing slave. If he does not find a slave to free, he must fast for two consecutive months as repentance to Allah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
