Q: There was a misunderstanding between him and his wife, and he became very angry because of it, so he said to her: “You are divorced,” and he repeated the statement several times with: (then) except that the first and second were certain, and he does not know whether he said it a third time or more or not? He mentions that he took her back immediately. He asks about the validity of his taking her back.
A: If the matter is as he mentioned, that he divorced her twice by saying to her: “You are divorced, then divorced” certainly, and as for what exceeded the second time, he does not know whether a divorce was issued by him or not, then if he had not divorced her before that, and his divorcing her was not for compensation, his divorce is a revocable divorce, and he has the right to take back his divorced wife as long as she is in the waiting period; because what exceeds the two divorces is doubtful, and the original state is its absence, and she remains with him after the taking back with one divorce. So if it is established that he took her back while she is still in the waiting period by the testimony of two just witnesses, his taking her back is valid.
