Fatwa number ( 714 )
Q: He was imprisoned for a period exceeding four years, and that after approximately two years of his imprisonment, his father visited him in prison and mentioned to him that his wife had caused fitnah (trial, discord or temptation) in their home, and that her presence in the house threatened the family unit, so he said in response: she is divorced three times, and that after approximately eight months had passed, he wrote a divorce paper stating three instances of divorce, and mentioned that he intended the previous divorce, and that after he was released and verified the reality of the matter, it became apparent to him that his wife was wronged by what was attributed to her, and that everything said about her was completely incorrect, rather, there are reasons to feel pity for her, to the end of what he mentioned.
A: If the matter is as the questioner stated, that he divorced his wife based on what was said about her, namely that she was the cause of fitnah (trial, discord or temptation) that arose in their home, and that her presence
in the house threatened the family with disintegration, and that after the period mentioned in the question had passed, he wrote a paper regarding his previous divorce of her, and that after he left prison, it became apparent to him that what was attributed to her was not true, and that she was innocent of all of it, and that what was attributed to her of causing fitnah (trial, discord or temptation) and threatening the family unit was a lie and slander, if this is established according to the Shari'ah, then the divorce of the one seeking the ruling has not taken place; because he conditioned it by the state of his situation on the truth of what was attributed to her, and it has been established that that was not true. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
