Moving the woman in the waiting period to another house out of necessity

Machine translationRead the Arabic original
Fatwa number ( 20924 )
Q: My sister's husband passed away in Riyadh this year, 1420 AH. My sister has a separate house of her own, and her neighbors are her husband's sons from another wife. Out of concern for our daughter, I told my mother: "Mother, stay with my sister until her waiting period of four months and ten days is over." My mother agreed—may Allah reward her with good—
and stayed with her for only three months and four days. After that, I received a call from my sister saying that my father is very sick and that I must come and take my father to Tabuk for treatment with me, as there is no one to take care of my father's hospital visits, since only my sister and my mother are there alone. If we leave them and take my father, they will be in confusion and fear, as they have no one else, and we are afraid for them. I immediately called my mother in Riyadh and informed her of the news that my father is sick. She asked: "What is your opinion?" I said: "My opinion is that you head directly to our house in al-Dairah with my older sister and her husband, and after you arrive, call me so I can come to take my father to me in Tabuk for his treatment. Do we have any sin in taking her while her waiting period has not ended, knowing the waiting period of a woman whose husband has died and its rulings?

A: If your sister, whose husband has died, moves from the marital home to another house during the waiting period of death out of necessity, such as fearing for her safety if she remains there alone, then there is no harm in that, and she completes her waiting period in the house to which she moved. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
