The questioner : A person caught up with the imam in the first rak'ah during the bowing. When the imam concluded the prayer, he stood up thinking he had a rak'ah to make up. And another person found himself in the same situation, except that when he remembered he had nothing to make up, he continued to complete the fifth rak'ah and concluded the prayer after the two prostrations for forgetfulness. What is the ruling? And what is the ruling if this happened and he completed the fifth rak'ah by mistake, not remembering until after finishing the prayer?

The Shaykh : It is obligatory for a person who stands up to an extra rak'ah in his prayer, whether he is a follower as in the question or not a follower, that he return as soon as he remembers. Even if he remembers while bowing, he should sit down; or if he remembers after rising from the bowing, he should sit down; or if he remembers while standing before bowing, he should sit down, even if he has begun the recitation. Accordingly, we say in answer to the first question: the man who caught up with the bowing, then stood up thinking he had not caught up with the rak'ah, and then remembered, it is obligatory for him to sit down and conclude the prayer, because he did not miss anything of the prayer. In this case, the imam has borne the prostration for forgetfulness for him, because he is not one who joined late. If a follower is not one who joined late, then the imam bears his forgetfulness.
As for the second question, the one who stood up to an extra rak'ah, then remembered and continued, concluded the prayer, and prostrated for forgetfulness, we say: if he did that intentionally, his prayer is invalid, because he added to it an addition intentionally. And if he did not do it intentionally, but rather he thought that if he stood up, he would not return until he completed his rak'ah, then his prayer is valid and it is not obligatory for him to repeat it.
And as for the third question, the one who did not remember that he had added the rak'ah until he was in the tashahhud, this is as the questioner mentioned: he completes the tashahhud, concludes the prayer, and prostrates two prostrations after the salam, and his prayer is completed.
