Q5: A man divorced his wife in his heart, so what is the ruling on that divorce? He did not state it explicitly, but he intended it in his heart and spoke of it to himself.
A5: Divorce does not take place except by uttering it or writing it down. As for merely intending divorce and speaking of it to oneself, no divorce takes place by that; because he (peace and blessings be upon him) said:Sahih al-Bukhari 5269 It is agreed upon that it is authentic. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
