Question:
From the Syrian Arab Republic, Damascus, the sender (A. B), using this code for his name, says: During a fit of extreme anger by the wife against her husband, she insisted on him and persisted in demanding that he divorce her, knowing that the husband had no desire to do so. He yielded to her request under compulsion and pronounced the divorce. Is this considered effective? Please inform us, may Allah reward you.

Answer:
Yes, as long as he divorced her of his own choice, and even if she was insistent, that is not an excuse for him; he is not obligated to divorce her. But as long as he responded to her desire and divorced her, the divorce is effective, provided he divorced her with a valid Islamic divorce during a period of purity in which he did not have intercourse with her, and she is not pregnant nor past childbearing age, or if he divorced her while she is pregnant, it is effective.
As for if he divorced her while she is menstruating, or in post-natal bleeding, and he knows this, knowing that she is menstruating or in post-natal bleeding, then the divorce is not effective according to the correct opinion, based on the hadith of Ibn 'Umar recorded in the two Sahihs. Or if he divorced her during a period of purity in which he had intercourse with her, and she is not pregnant nor past childbearing age, and he knows this, then it is not effective according to the correct opinion, based on the hadith of Ibn 'Umar. Yes.
