Q: I have attached to your Excellency a true copy of the divorce issued by me to my wife (J.M.) in the year 1389 AH. I did not issue a specific number of divorces, and I did not intend anything other than what is written in the divorce document. She has not remarried to this day, and I have a desire to return to her, and she has no objection to that. So give us a ruling on this regarding its permissibility and prohibition. The following phrase appeared in the copy of the divorce document dated 1/3/1389 AH: ( I admit and confess that I divorced my wife (J.M.).
A: After the Committee studied the question and the divorce document, it answered as follows: If the matter is as you described in your question, and as the phrase of divorce in the document states, then what occurred from you is considered one divorce. If this divorce of yours was not the third of three divorces, it is permissible for you to return to your wife with a new contract and a new mahr, with her consent, if she has exited the 'iddah without you taking her back during it. And if it was the third of three divorces, she is not lawful for you until she marries another husband with a valid marriage, and he enters with her, then he divorces her, and she completes her 'iddah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
