Getting rid of her mother
Machine translationRead the Arabic original
Fatwa number ( 1899 )
Q: A verbal dispute occurred between me and my wife, and her sister threatened me, hit me, and broke my jaw. When I came to leave with her, her mother insisted on me, saying: "You will not leave unless you divorce her." I said: "If your aim is divorce, then when her father comes, Allah will give him what He gave me." I considered this statement a divorce, and I intended to get rid of her until the men come and resolve the problem. Is this considered a divorce or not?
A: If the situation is as you described, that you did not intend divorce by saying: "If your aim is divorce of your daughter, then when her father comes, Allah will give him what He gave me," and you only intended by that to get rid of your wife's mother and sister until the men are present and you can discuss a solution to the problem—then this is not considered a divorce. This is based on the established statement of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 1
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
