Q: The questioner married a woman, and she bore him children, then his mother demanded he divorce his wife without any reason or defect in her religion, but rather for a personal need. His sister and some people of good tried to convince her, but she was not convinced except by his divorce. She left the house and went to live with one of her daughters, so there was difficulty caused by her leaving. However, his wife is dear to him, and he has only known good of her. What should he do? Please issue a ruling for us.
A: If the situation is as the questioner described, that his wife’s conduct is upright, that he loves her and she is dear to him, and that she has not wronged his mother, but rather her mother disliked her for a personal need, and he holds onto his wife and maintains the marital life with her—then he is not obligated to divorce her in obedience to his mother; for it is established from the Prophet (peace and blessings be upon him) that he said:Sunan Abi Dawud 2625Sahih (Al-Albani) He must be dutiful to his mother and maintain ties with her by visiting her, being gentle with her, spending on her, and comforting her with what she needs and what brings her peace of mind, and pleasing her with what he is able to do, except for divorcing his wife. And Allah is the Helper. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
