Q: I am a man who married my cousin’s daughter. Since I married her while hating this marriage and having no desire to marry her, but my father insisted on it and on marrying her, and said to me: “If you do not get along with her, divorce her,” and I have now been in the Kingdom for three years without going to Egypt . Now I want to travel and I want to divorce her, because I am severely shorting her of her rights due to my lack of desire for her, and I am shorting her of her marital rights. So, if I divorce her, will I have wronged her? And does she have any right against me? Please inform us, may you be rewarded.
A: If the situation is as you described in your question, it is prescribed for you to take the means to improve the situation, so that reconciliation may occur with kindness. If you are unable to do so and you insist on divorce, let it be a release with kindness, a single pronouncement of divorce. You are obligated to provide her maintenance, clothing, and housing for the duration of the waiting period, and likewise for the time before that if
you had not been providing for her, unless she permits you to do so. If it appears to you that you should take her back, you have that right as long as she is in the waiting period, provided that this pronouncement of divorce was not preceded by two previous pronouncements. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
