Q: He married a Muslim woman named (Z.A.Z). Before he married her, she was a Christian. Then he doubted the validity of her Islam, and problems began between them. This was confirmed by her going to churches and monasteries in his absence. Then he was surprised by her traveling from his home in Tanta to Cairo , and she spoke to him by telephone from Cairo , asking him for a divorce. But he did not divorce her. Then her brother came to him
and asked him to divorce her, explaining to him that she had become forbidden to him three years ago due to her apostasy to the Christian religion. He asks: Has she become forbidden to him by Islamic law, and what is the ruling of the law regarding her apostasy without my knowledge, knowing that she lived with me for five years and I did not know of her apostasy?

A: If the matter is as the questioner mentioned, then his wife has become forbidden to him due to her apostasy, and she is not lawful to him except if she repents from her apostasy and returns to Islam. Allah the Exalted said:
And hold not to marriage bonds with disbelieving womenوَلاَ تُمْسِكُوا بِعِصَمِ الْكَوَافِرِ
[Al-Mumtahanah 60:10]
And He said:
And whoever denies the faith - his work has become worthless, and he, in the Hereafter, will be among the losers.وَمَنْ يَكْفُرْ بِالإِيمَانِ فَقَدْ حَبِطَ عَمَلُهُ وَهُوَ فِي الآخِرَةِ مِنَ الْخَاسِرِينَ
[Al-Ma'idah 5:5]
Her marriage to him is part of her deeds, so it was nullified by her apostasy. The ruling of the Islamic Shari'ah regarding her is that she is to be killed, except if she repents from her apostasy and returns to Islam; due to the generality of the saying of the Messenger of Allah (peace and blessings be upon him):
Whoever changes his religion, execute him.من بدل دينه فاقتلوه

And the ruling regarding her, as mentioned above, of her being forbidden to him and her being killed for apostasy, is the same whether he knew of her apostasy or did not know of it. However, he is excused for having intercourse with her and enjoying her during the period in which he did not know of her apostasy. As for the questioner's statement: (And what is the ruling of the law regarding her apostasy without
my knowledge), it is not permissible to direct such a matter to a non-Islamic authority; because referring to judgment other than what Allah has revealed is disbelief, injustice, and open sinfulness. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
