Q1: We inform you that many tribes have become accustomed to imposing the blood money on the 'aqilah, whether the killing was intentional or otherwise, as well as for wounds, whether few or many. We hope you will clarify what is permissible in this regard and what is not. Also, if the tribe's custom agrees on something of what we mentioned, is that acceptable or not?
A1: The ruling that blood money is the responsibility of the 'aqilah applies only to accidental killing or quasi-intentional killing. As for the blood money for pure intentional killing, the 'aqilah does not bear it; rather, it is the responsibility of the perpetrator alone. If the members of the 'aqilah agree to bear it with him or help him with the blood money, there is no harm. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
