The Shaykh : He says: If a man intentionally killed his full brother, what is his obligation? And if it was accidental, is the blood money obligatory, and to whom is it owed? If it was intentional, then if the conditions for retaliation are met, he is executed for it, based on the saying of Allah the Exalted:
prescribed for you is legal retribution for those murdered كتب عليكم القصاص في القتلى
[Al-Baqarah 2:178]
And if it was accidental, the blood money is on the 'aqilah, and he owes an expiation of freeing a slave. If he does not find one, then fasting for two consecutive months.
